TOS Updates
Uploadingit may modify the Agreement which will become effective immediately upon posting on the website. Your continued use of the website and any associated services, the "Services", indicates your acceptance of the Agreement. If you are dissatisfied with anything related to the Uploadingit website, your sole remedy is to discontinue use of the Services. Your use of the Uploadingit website and services is at your own risk.
Uploadingit website and services are available to anyone over the age of 13, in observance of and compliance with the Children's Online Privacy Protection Act, who complies with the Uploadingit Agreement, AUP and Privacy Policy. Anyone not in compliance may be removed and banned from the services without prior notice. Uploadingit reserves the right to terminate your access to any and/or all parts of the services at any time for any reason without prior notice or liability. The terms of this Agreement, AUP and Privacy Policy shall survive any termination of your access to the services.
Account Termination
We Uploadingit have the right to terminate your account for any reason, at any time, without notice, at our discretion. We will not backup any of your files before termination, in the termination process all of your files are physically deleted. We also have the right to suspend your service at any time, for any reason, without warning. We are not responsible for data loss of your account has been terminated or suspended.
Uptime & Content
We put ever effort into making sure that Uploadingit is up, 24/7/365, This is not by any means a guarantee, And we are in no means responsible for any service down time or loss of data due to down time.
You, not Uploadingit, are solely responsible for the Content you upload and store on Uploadingit's servers. You bear full responsibility and sole liability for any lost or irrecoverable data. You understand and agree that Uploadingit reserves the right to delete, move or edit any Content that it may determine violates this Agreement, its Acceptable use Policy, Privacy Policy or is otherwise unacceptable and may terminate your access to the Services, without prior notice and at its sole discretion. You understand that you may be exposed to offending content and waive your right to any damages.
User(s) are in no way allowed to upload any adult, offensive, or illegal content to the Uploadingit service. Users that upload offending content to the service will have the account suspend and our terminated, all files associated with the user(s) account will be deleted. If we determine it to be necessary we may notify your ISP and or local law enforcement. You take full responsibility for the content you upload.
Uploadingit has the right to remove files displayed on sites with any display of, affiliation with or links to illegal content. At all times you are fully responsibility for all files and information hosted in your Uploadingit account. You are completely responsible for the security of your account details and agree that you are fully responsible for any acts inside of your account.
Email Updates
By registering for the Uploadingit website and services you are agreeing to receive emails containing but not limited to information about current and future Uploadingit services, service updates and account related updates.
If your account is suspended or terminated for any reason you are not automatically removed the mailing list for updates from Uploadingit. It is your job to remove your self from the mailing list by opening a support request, sending a email to admin@uploadingit.com asking to be removed or by clicking a unsubscribe link at the bottom of a received email. Uploadingit is not at all reasonable for emails that you may receive.
Information Collection
At any given time, the following data and information about a user may be collected IP Address, Email address, Tracking cookie, Time at which a file(s) is uploaded, modified, deleted or accessed, File's URL, Referrer logs, Operating System, Registration cookie, MAC Address. This information will be kept securely and we will never, ever, sell, donate, lend or give your personal information away.
The above-listed data and information is used in conjunction with its respective services. Some of the above-listed information may also be used in an effort to assist law enforcement entities regarding the uploading of illegal content.
Liability
UPLOADINGIT WILL IN NO WAY BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INCIDENTAL, INDIRECT, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF GOODWILL OR PROFIT, FOR ANY MATTER, WHETHER SUCH LIABILITY IS ASSERTED ON THE BASIS OF CONTRACT, TORT, OR OTHERWISE, EVEN IF UPLOADINGIT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
