1. Uploadingit.com may modify the Agreement which will become effective immediately upon posting on the website. Your continued use of the website and any associated services, the "Services", indicates your acceptance of the Agreement. If you are dissatisfied with anything related to the Uploadingit.com website, your sole remedy is to discontinue use of the Services. You use the Services of Uploadingit.com at your own risk.

2. Uploadingit.com Services are available to anyone over the age of 13, in observance of and compliance with the Children's Online Privacy Protection Act, who complies with the Uploadingit.com Agreement, AUP and Privacy Policy. Anyone not in compliance may be removed and banned from the Services without prior notice. Uploadingit.com reserves the right to terminate your access to any and/or all parts of the Services at any time for any reason without prior notice or liability. The terms of this Agreement, AUP and Privacy Policy shall survive any termination of your access to the Services.

3. We Uploadingit.com have the right to terminate your account for any reason, at any time, without notice, at our discretion. We will not backup any of your files before termination, in the termination process all of your files are physically deleted. We also have the right to suspend your service at any time, for any reason, without warning.

4. We put ever effort into making sure that uploadingit.com is up, 24/7/365, This is not by any means a guarantee, And we are in no means responsible for any service down time.

5. You, not Uploadingit.com, are solely responsible for the Content you upload and store on Uploadingit.com's servers. You bear full responsibility and sole liability for any lost or irrecoverable data. You understand and agree that Uploadingit.com reserves the right to delete, move or edit any Content that it may determine violates this Agreement, its AUP, Privacy Policy or is otherwise unacceptable and may terminate your access to the Services, without prior notice and at its sole discretion. You understand that you may be exposed to offending Content and waive your right to any damages.

6. If your copyrighted or trademarked works are on the Uploadingit.com website without your permission, please contact admin@uploadingit.com describing the work that has been infringed, where it is located on the website, and provide your contact information and a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the owner, or authorized by the owner, of the copyrighted or trademarked work. Illegal files will be removed immediately after notice with sufficient information.

7. User(s) are in no way allowed to upload any adult, offencive, or illegal content to the uploadingit.com service. Users that do upload content that is not allowed on the service will have the account suspend, and all files will be deleted. If we deam necessary we may notify your ISP and or local law enforcement.

8. Uploadingit.com has the right to remove files displayed on sites with any display of, affiliation with or links to illegal content. At all times you have full responsibility for all files and information hosted on uploadingit.com. You are completely responsible for the security of your account details and agree that you are fully responsible for any acts inside of your account.

9. If your Account is suspened for any reason you are not removed the mailing list for updates from uploadingit.com. It is your job to remove your self from the mailing list by opening a support ticket or sending a email to admin@uploadingit.com asking to be removed. Uploadingit.com is not at all resasonable for emails that you recive.

10. You are also fully responsible for any extreme changes in server load brought on by your content uploaded, any mail bombs on the server or DDOS attacks brought to the server due to your uploaded file.

11. Uploadingit.com has full rights to terminate any account which is believed to be linked with unsolicited email / SPAM.

12. Uploadingit.com may contain links to third party websites. By use of the Services, you expressly relieve Uploadingit.com from any and all liability arising from your use of any third-party website.

13. Upgrades and other changes in uploadingit.com?s network, including, but not limited to changes in its software, hardware, and service providers, may affect the display or operation of Customer?s hosted content and/or applications. Uploadingit.com reserves the right to change its network in its commercially reasonable discretion, and uploadingit.com shall not be liable for any resulting harm to Customer and or the Customer's files.

14. The following types of files may not be uploaded under any circumstances:

1. Files that are Pornographic. This includes, but is not limited to, persons under the age of 18 either posing as "models" or taking part in otherwise sexually implicit or explicit situations.
2. Files that are illegal and/or are in violation of any United States laws pertaining to digital content usage (DMCA).
3. Files that infringe on the copyrights of any entity. This includes, but is not limited to, copyrighted photographs, as well as files for which user lacks usage and distribution permissions.
4. Files whose intended use or purpose is to harass individual or multiple persons.
5. Files whose intended use or purpose is the promotion of products or services through advertisements for the purpose of commercial profit. This includes, but is not limited to, email spam and banner advertisements.
6. Files that are not of the allowed file types.
7. Files that are intended to harm the Uploadingit.com servers, and any users computers.

15. At any given time, the following data and information about a user may be collected:

1. IP Address
2. Email address
3. Tracking cookie
4. Time at which a file(s) is uploaded, modified, deleted or accessed
5. File's URL
6. Referrer logs
7. Operating System
8. Registration cookie
9. MAC Address

16. The above-listed data and information is used in conjunction with its respective services. Some of the above-listed information may also be used in an effort to assist law enforcement entities regarding the uploading of illegal content. Uploadingit.com is committed to privacy and will never, under any circumstances, sell, distribute, or otherwise reveal personally identifiable information to any non-law-enforcement or third party entities.

17. UPLOADINGIT.COM WILL IN NO WAY BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INCIDENTAL, INDIRECT, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF GOODWILL OR PROFIT, FOR ANY MATTER, WHETHER SUCH LIABILITY IS ASSERTED ON THE BASIS OF CONTRACT, TORT, OR OTHERWISE, EVEN IF UPLOADINGIT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
